The three men accused of the murder of Daphne Caruana Galizia have asked a court to put off testimony by FBI agents in the compilation of evidence until a separate issue concerning a court-appointed expert is resolved by another court.

Alfred and George Degiorgio and Vincent Muscat stand accused of the car bomb murder of Daphne Caruana Galizia on October 16.

The FBI agents, which assisted the Malta police in their investigations, are due to give evidence when the compilation of evidence resumed on May 22. Their part of the investigation focused on mobile telephony and data traffic.

Alfred Degiorgio had filed a constitutional application claiming that the appointment of Dr Martin Bajada as IT expert in the case was in breach of his right to a fair hearing.

All three accused are now insisting that the FBI agents should not testify until the constitutional issue is resolved.

“The outcome of the Constitutional case could influence the evidence which will be exhibited in the proceedings insofar as the witnesses worked with Dr Martin Bajada and the evidence is the result of his work,” the three accused declared.

Should the Constitutional case be decided in favour of Alfred Degiorgio, “everything that Dr. Bajada did, both alone and with others, must be declared invalid,” the court was told.

Lawyers William Cuschieri, Martha Mifsud, Josette Sultana and Martin Fenech signed the application.
