Forensic tests revealed no signs of sexual abuse on a three-year-old girl following allegations her mother had made against the father.

A court was told of this medical examination during the compilation of evidence against Rita Borg, from Mosta, who stands charged with making calumnious allegations against her former boyfriend, William Micallef, and with filing a false police report about something she knew had not taken place.

Magistrate Anthony Vella heard that on April 3 last year, the woman filed a report at the Naxxar police station that Mr Micallef had sexually abused their daughter. This was based on her daughter telling her that he had touched her [in her private parts] and she had felt pain.

Police Inspector Josric Mifsud said he immediately informed the duty magistrate who appointed a court expert to examine the child.

The expert, Mario Scerri, found there were no signs of sexual abuse or penetration. The police then filed criminal charges against the mother, charging her with filing a false report.

Inspector Mifsud said Mr Micallef usually picked up his daughter from the Naxxar police station in accordance with a court decree granting him visiting rights. He often saw Ms Borg and Mr Micallef joking inside the police station.

Police Sergeant Kevin Buhagiar testified that he had briefly spoken to the young girl and asked her whether her dad had ever done anything to her that hurt her but she said no.

The police also investigated the mother’s complaint that her daughter was removing her underpants to go to the toilet. Sergeant Buhagiar said he had spoken to the child’s teacher who assured him that this was very normal for children her age, especially when they would have just been potty trained and started wearing pants instead of nappies.

Mr Buhagiar said he summoned Mr Micallef to the police station to see what he had to say about the claims.

In his statement to the police, Mr Micallef said Ms Borg had told him she was prepared to leave her husband if he left his wife and they could then move in together.

However, he told her he had no intention of leaving his wife for her, even though she was the mother of his child. He said this happened just before these claims were made about him.

The case continues in January.

Lawyer Daniela Mangion appeared for the accused, while lawyers Jason Azzopardi, Kris Busietta, and Martin Fenech appeared parte civile for Mr Micallef.
