Risk of a serious breach of EU values

Who can take the initiative to report the risk of a serious breach of EU values?

The new Constitution for Europe lays down that either one third of the member states or the European Parliament or the European Commission may take the initiative to report such a risk to the Council of Ministers. The Council then, acting by a majority of four fifths of its members and after obtaining consent from the European Parliament, may decide there is a clear risk of a serious breach by a member state of EU values. Before deciding, the Council shall hear the member state in question and may address recommendations to that state.
