A 52-year-old man was yesterday cleared of attempted murder after a magistrate ruled that he had acted in self defence.

Magistrate Consuelo Scerri Herrera heard how Anthony Fenech shot Carmel Pace following an argument between the two when Pace was trying to break down the door of his apartment.

She heard how the argument broke out because Fenech had not helped Pace with his water tank. On June 26, 2002, Fenech was in his balcony when Pace passed by and started shouting insults at him. Fenech told Pace that if he had something to say he should go upstairs.

Pace ran up the stairs and Fenech, scared, threw a pot of boiling water down the stairs to try and stop him but Pace managed to get to his front door and hit it aggressively.

That was when Fenech went to get his revolver and fired a shot injuring Pace.

The magistrate fined Fenech Lm200 for firing a gun in a residential area without a licence.

Police Inspector Robert Gregory prosecuted.

Dr Joseph Giglio and Dr José Herrera represented Fenech.
