Elderly man admits stealing from neighbour's car
He is returning the items and cash
A 68-year-old man has been handed a suspended prison sentence after he admitted to stealing items from his neighbour's car.
Joseph Muscat, from Naxxar, was accused of aggravated theft and recidivism.
Police inspector Ylenia Maria Xerri told the court that the owner of the vehicle filed a report on July 24. The vehicle was parked on Triq is-Simblija when someone stole a first aid box, two sunglasses, and €170 in cash.
The police identified the suspect, and he was arrested on Saturday.
Xerri explained that Muscat returned the sunglasses and first aid box and told the police that he was willing to refund the stolen cash.
Muscat admitted to the charges during his arraignment.
Prosecutor Martina Calleja said that in view of his early admission, the prosecution was asking for an 18-month prison term suspended for two years.
Legal aid lawyer Axl Camilleri said his client would need some time to pay back the stolen cash due to his “difficult [financial] situation.”
The prosecution also requested a protection order, highlighting that the accused and his victim are neighbours. The defence added that in this case he should be barred from speaking and harassing the victim.
After hearing the submissions, the court handed the accused an 18-month prison sentence suspended for three years. He was ordered to repay the €170 within six months. A restraining order was issued in favour of the victim, with the court telling Muscat to avoid speaking to the victim and his family. Muscat raised his hand and said: “he sometimes parks outside my residence.”
“Don’t speak to him and call the police,” the court warned.
Magistrate Charmaine Galea presided. AG lawyer Martina Calleja prosecuted assisted by police inspector Ylenia Maria Xerri. Legal aid lawyer Axl Camilleri appeared for the accused.
