Enemalta Corporation has filed a reply contesting an application filed against it by engineer Kenneth Abela.

Abela had requested the First Hall of the Civil Court to prohibit the corporation from assigning his post at work to a third party. The court was also asked to prohibit the corporation from portraying Abela as having committed acts contrary to the corporation's interests.

However, in yesterday's reply, the corporation declared that Abela's application ought to be dismissed by the court as the legal requisites for the issue of such a warrant did not exist in this case.

Enemalta declared that in order for an application to be successful the applicant had to prove that the warrant was necessary for the protection of his rights and, furthermore, applicant had to prove that he enjoyed such rights on a prime facie basis.

Abela, the corporation added, was labouring under the misconception that as he had worked as "acting manager" of the gas division then he had some automatic right to be appointed division manager. Such right did not exist, as Abela had been clearly informed in writing when he was transferred to the gas division originally.

Furthermore, it did not result that Abela had some objective right to stop the corporation from employing another person to the post of manager of the gas division.

When referring to Abela's second request with regard to his reputation, the corporation submitted that this was totally frivolous and ought to be dismissed by the court.
