Does EU law ban discrimination against persons with a disability?

Yes. This was adopted in November 2000 and covers equal treatment in employment and occupation. It will enter into force in December 2003. It deals with both direct and indirect discrimination and it also covers other forms of discrimination, not just on the basis of disability.

If a person feels discriminated on the basis of disability, they have a right to a legal remedy against their employer and the burden of proof shifts from them on to the employer.

The law also protects the person who takes action from victimisation. But this law does not cover discrimination outside the workplace.
