A 43-year-old man who picked up furniture items left lying by the road when he suspected them to be stolen was yesterday fined Lm300 for theft.

Magistrate Consuelo Scerri Herrera noted that John Zammit, of Birkirkara, had admitted taking the items when he thought they could be stolen and therefore he was guilty of theft.

The magistrate heard how Zammit was with Carmelo Zammit, 43, of Mosta when they found the items. Carmelo Zammit took a ceramic jug home and John Zammit took some furniture items.

However, the magistrate noted that unlike John Zammit, Carmelo Zammit genuinely believed that the jug he took home had been disposed of by its previous owner and consequently she cleared him of theft.

Police Inspector Jeffrey Azzopardi prosecuted.
