Mr Justice Lino Farrugia Sacco in the Tribunal for the Investigation of Injustices yesterday dismissed as application filed by Emanuel Camilleri against the Director of Works.
In 2000 the Auxiliary Workers and Training Scheme (AWTS) and the Employment Training Corporation (ETC) were called into the suit.
Camilleri submitted that he had suffered an injustice when his employment with the Dejma was terminated in November 1989.
The director of works pleaded that he ought not to have been sued as Camilleri had never been a Works Department employee.
According to respondent Camilleri had been transferred to the AWTS from the Dejma and had then been seconded to work at the Works Department.
The department had been informed by the AWTS that Camilleri's employment had to be terminated as he had refused the offer of permanent work.
On its part the ETC pleaded that it had been called into the suit after the time limit for the filing of claims before the tribunal had lapsed.
The tribunal concluded that as Camilleri was not a Works Department Employee the Director of Works ought not to have been sued.
The plea of the ETC was also upheld and the tribunal dismissed Camilleri's application.
