A lawyer has filed a judicial protest against director general of courts after a case file went missing resulting in him being criticised by a judge for filing submissions late.

Lawyer Stefano Filletti filed the judicial protest arguing that he had only filed the submissions late because he was notified late as the case file had gone missing.

Dr Filletti said that in the case Michael Attard Limited vs Albert Vella, a verbal submission was made in the case on Tuesday in which the presiding judge criticised him for filing submissions late.

On further investigations, it resulted that the filed had gone missing and when it was found he had been notified which made it seem as though he had filed submissions late.

He said that the presiding judge did not know about the file being lost and it was only after he looked into what had happened that the truth came out.

The file was later tracked down.

Dr Filletti said that he was holding the director general of the courts responsible for any damages and that might have arisen from this situation.
