A Libyan man yesterday claimed his deportation was being delayed unnecessarily and he was thus being held under arrest illegally.

Mahmud Abudumehdn Tarek, 26, filed a writ in the Magistrates' Court explaining how he had been convicted of the possession of cannabis with intent to sell and assaulting police and jailed for 18 months by the Magistrates' Court.

The sentence was eventually confirmed by the Court of Criminal Appeal last month and this set into motion a deportation order.

Tarek claimed he had been held under arrest since, awaiting the execution of the deportation order but he was still waiting despite the fact that there had been several flights to Libya.

He claimed that his arrest was illegal and he should be released.
