A man run over in a traffic accident in February 1997 has been awarded damages amounting to Lm4,814.37 by Mr Justice Raymond C. Pace in the First Hall of the Civil Court.
John Bianco, accompanied by his wife Doris, filed the writ of summons against Joseph Fenech Adami. They claimed that John Bianco had been run over by defendant while crossing the road at Kirkop. The court was requested to condemn defendant to make good the damages he had sustained.
It resulted that Bianco was crossing the road leading to the Elbros factory at Kirkop when he was hit by a car driven by the defendant.
From the evidence it resulted that Bianco was at least half way across the road when he was hit by the car. It resulted that defendant had just emerged from the factory and had turned onto his right without taking the necessary precautions of stopping and having a good view of the road. It was clear, said the court, that the defendant had failed to keep a proper lookout and had not seen plaintiff who was in plain view.
Mr Justice Pace declared that it resulted from the medical experts' opinions that Bianco had sustained a three per cent permanent disability and the defendant was ordered to pay the Biancos damages amounting to Lm4,814.37.
