Man fined €100 after damaging parked car with sulky

The man was found to have been driving negligently

A 37-year-old Cospicua man has been fined €100 after a court found him guilty of negligently causing damage to a parked vehicle.

Christian Cardona was arraigned in court charged with negligent driving and causing damage through negligence. He was further accused of driving a sulky on the road for which he had no licence or insurance cover, among other charges.

He pleaded not guilty.

The car owner, Justin Abela, told a court Monday that on November 2, 2022, he was at a bar on Triq it-Tiġrija in Marsa when he heard a noise. He headed out and saw Cardona leading his horse and sulky away from Abela’s parked vehicle.

Abela testified that the Toyota Vitz, which he regularly used, belonged to his partner. He chased Cardona to the stable and said he tried to settle the matter without calling the police, but later filed a report.

Cardona testified that he had not been riding on the sulky but had opted to hold the horse’s head and walk him back to the stable after leaving the racecourse due to heavy traffic.

He said he had briefly hit the car with the sulky, adding the car had been parked on a yellow line. He also testified that he told Abela that he would first sort out the horse and then come to the bar and settle the issue.

The court found Cardona guilty of causing damage to the vehicle through negligence and fined him €100. It also ordered that four points be taken from his licence.

Magistrate Yana Micallef Stafrace presided.
