A man yesterday filed a challenge against the Police Commissioner requesting the police to take criminal action against his wife for exercising a presumed right over their children.

In the challenge, filed in the Magistrates' Court, the man explained that his wife left home with their two children on August 22. He had then filed an application in the Family Court, which upheld his request to see his children at least twice a week.

But since his wife had escaped he had not seen his children and therefore he filed several police reports demanding criminal action against her for exercising a presumed right over the children when she failed to give him access to the children as ordered by the Family Court and for holding the children against their will.

He explained that the police had told him that his wife was in a safe place but did not take the criminal action requested.

To make matters worse, he could not go anywhere near the governmental agency where his wife and children were staying but he had evidence that a friend of hers had access.

The government agency could not replace the will of the court or that of the children's father.

The man requested the court to order the Police Commissioner to take criminal action against his wife.

Dr Joseph Brincat filed the challenge.
