A creditor yesterday challenged the police commissioner to take criminal action against businessman Sebastian Dalli for fraud, claiming Dalli had failed to deposit Lm700,000 in an account out of which he was due Lm250,000.
Joseph Gaffarena filed an application in the Magistrates' Court challenging the commissioner to take action.
He claimed he had written to the commissioner on October 24 last year, requesting him to initiate criminal proceedings against Dalli for fraud to his detriment.
Gaffarena claimed Dalli transferred the assets of Mixer Limited to Mixer Concrete Works Limited. The books showed that the transfer took place against Lm700,000 but the money was not deposited in the account of Mixer Limited, according to auditor Mark Scalpello.
Gaffarena claimed this constituted fraud because Dalli had transferred the assets only to avoid paying his creditors and the police commissioner had failed to take action within a reasonable time.
Dr Keith Bonnici signed the challenge.
