Unauthorized developments lead to enforcement notice at Ħondoq kiosk
A popular kiosk at Ħondoq ir-Rummien has been served an enforcement notice by the Planning Authority.
The notice lists several works carried out on the site without proper planning permission.
Works include an iron structure covered with a canvas roof and sides, solar panels, the construction of a WC and ironwork surrounding the kiosk.
Additional tables, chairs and fixed umbrellas were also set up on site without planning approval.
The enforcement notice was served on March 28.
The original permit allowed for a kiosk with tables and umbrellas to be set up under specific conditions.
Any external apertures could not be constructed of gold, silver or bronze aluminium, and no services were to be located on the roof of the building. The iron structures and solar panels go contrary to this condition.
The kiosk was also supposed to be a temporary summer structure to be removed on October 15 every year.
According to the enforcement notice, the kiosk remained fixed in place and was never removed in the colder months.
Previously, the owner of the kiosk had requested a concession by encroachment with Lands Authority to sanction an illegal canopy extension and additional outdoor seating at the kiosk.
The Lands Authority refused to grant consent for the sanctioning, a decision that was later upheld by the Court of Appeal.
