Prison leave concession

I refer to the article carried on page 40 on Monday. In the article it was repeatedly stated that prison leave was given to Mario Camilleri "on the court's recommendation". This is incorrect. A court of criminal justice cannot recommend prison leave.

In the article it was repeatedly stated that prison leave was given to Mario Camilleri "on the court's recommendation". This is incorrect.

A court of criminal justice cannot recommend prison leave. Regulation 61(2)(b) of the prison regulations merely provides that, in the case of unconvicted prisoners, any authorisation by the competent authority, if necessary, shall be requested prior to the granting of leave by the director of prisons.

Following three separate applications filed by Camilleri for such authorisation, the Criminal Court, after taking note of the reply by the Attorney General, in three separate decrees stated that for the purposes of the said regulation 61(2)(b) it had no objection to the request.
