Two men who had been given a suspended jail term for theft were yesterday jailed after appeals filed by the Attorney General.
In both cases Mr Justice Joseph Galea Debono, presiding over the Court of Criminal Appeal, ruled that since the men had been found guilty of relapsing, their jail term could not have been suspended.
Kevin Azzopardi had originally been given an 18-month jail term suspended for two years for stealing three watches from Zak Boutique in Valletta, the possession of a penknife, causing damage at the shop and relapsing on May 12, 2000.
In a separate case Andrew Formosa had been given a two-year jail term suspended for two years for breaking into two cars in Sliema, stealing, damaging the cars and relapsing on November 9, 2006.
Mr Justice Galea Debono jailed Mr Azzopardi for 18 months and Mr Formosa for two years.
