Although our establishment, Nero Kafe, was not mentioned in the article, I would like to state that the mobile kiosk is situated far closer than the 50 metres allowed by law. In fact the distance between the kiosk and Nero Kafe is less than 30 metres.

According to the article, the vendor has a hawker's licence. It is very clear that a hawker's licence does not permit the vendor to take up a permanent place but to drive around and stop where necessary to sell his wares.

In an e-mail from Audrey Testa De Noto of the ADT it is stated that the Traffic Management Directorate checked the layout plans as approved by Mepa and there is no indication of any provision for a fixed ice cream vendor in St George's Bay adjacent to the Villa Rosa wall. In fact, the parking space reserved for people with special needs was removed and a platform was built to house this kiosk.

We feel that this is unfair competition. We pay thousands of liri for permits and employees' wages.

The situation should be solved through a very simple exercise. The police authorities should measure the area and act accordingly. Otherwise there would be no option but to let the courts decide.
