Jonathan Agius, 27 of St Paul’s Bay, was today found not guilty of having injuring a patron at Fuego nightclub, St Paul’s Bay, in an incident which happened on March 5, 2006.

He had been accused of seriously injuring David Lucey and slightly injuring his brother Paul.

Magistrate Audrey Demicoli said CCTV recording showed that David and Paul Lucey had pushed the accused to the floor and started beating him.

She noted that a police report about the incident was filed two days after the incident, and the court had doubts about their credibility.

The accused had told the court that on the night in question he had seen David and Paul Lucey acting irrationally and he had kept an eye on them.

At one time one of the siblings told him not to annoy them and he was then pushed to the floor and assaulted.
