Woman says she was raped twice in a garage - alleged aggressor denied bail

A 47-year-old man has been remanded in custody after being charged with raping a woman twice. 

Ivitsa Mitskovski was arraigned before Magistrate Jean Paul Grech on charges of alleged sexual assault and rape, to which he pleaded not guilty.

The prosecution said the investigation began on the evening of June 7, when the alleged victim reported to the police that she had been raped. She said that she had attended a biker event at a bar where she chatted and drank with several individuals, including a man known by the nickname ‘Bambi’, later identified as the accused. 

At approximately 5am, the accused offered to drive her home on his motorcycle.

The court heard that although the victim lived in Burmarrad, Mitskovski allegedly took a wrong turn, driving instead toward St. Paul’s Bay and proceeding to a garage.

Mitskovski told the woman he needed to do something inside and invited her in before he would drive her home. Once inside, the accused allegedly demanded sexual intercourse. Despite her refusals, he forced himself on her and raped her twice, the police were told.

Following the alleged assault, the victim contacted a friend to pick her up.

Mitskovski was arrested on June 22. Investigators tracked him using a mobile phone number provided by the victim.

The defence requested bail, arguing that their client is self-employed as a locksmith and has a fixed residence in Malta. However, the prosecution noted that official records at Jobsplus did not support his stated employment status.

Magistrate Grech denied the request for bail, citing the lack of verified employment, the absence of family ties in the country, and discrepancies between the residence details provided by the defence and the information held by the police. The court also noted that the victim has yet to testify. A protection order was issued in favour of the victim.

Inspector Dorianne Tabone and Warren Galea assisted by lawyer Jurgen Dalli from the Attorney General's Office prosecuted. Lawyers Franco Debono and Herman Mula appeared for the accused.
