A court yesterday awarded a motorbike rider almost €23,000 in damages following a traffic accident that occurred in January 2005.

The judgment was delivered by Mr Justice Lino Farrugia Sacco in an action filed by Godfrey Ciangura against Carmen German.

Mr Ciangura told the court that he had been riding his motorbike in St Dominic Square, Rabat when a collision occurred between a car driven by Ms German and his bike. He claimed that he had suffered a permanent disability as a result of the accident. The court heard testimony from eyewitnesses to the effect that it was Ms German who had collided with Mr Ciangura, hitting him with the right front mudguard.

Ms German said that she had not seen Mr Ciangura until the last minute but the judge concluded that Ms German had not been keeping a proper lookout and that she was responsible for the accident.

In conclusion, the court ordered Ms German to pay Mr Ciangura €22,975.92 in damages.
